(a) Diagnostics and Repairs: ShivShakti Computers will attempt to diagnose your laptop computer and/or other computer related equipment problem, provide an estimate of applicable service fees (plus parts if required), and then provide you with a repair solution. In certain cases, however, diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control.

(b) Your Responsibility: While ShivShakti Computers will make all reasonable efforts to safeguard the contents (data) stored on your computer, you understand and agree that prior to contacting or allowing ShivShakti Computers to perform diagnostic, repair, or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives if you so desire. You acknowledge and agree that ShivShakti Computers and/or its third-party service provider shall not be responsible under any circumstances for any loss, alteration, or corruption of any software, data, or files.

(c) Service Fees: You acknowledge that the flat labor rates on ShivShakti Computers apply to each repair component do not include the cost of parts.

If ShivShakti Computers is successful in providing a repair solution you understand that the minimum labor/service fee.

You further acknowledge and agree that ShivShakti Computers will provide diagnostic testing of your laptop computer and/or other computer related equipment only if you agree to complete the recommended service at the price quoted.

In the event that you should decline quoted service you agree to pay a minimum service fee in the amount plus pickup and return shipping charges.

If you have paid minimum diagnostic charges and got higher quotation of repairing which is out of you budget. If you want to get the services within 7days of quote Shivhshakti will not take diagnostic charges again and follow the same quotation. Conditions apply- If quote product price got any price fluctuation that current price will be applied and will not follow old quotation.

 (d) Abandonment of Property: If you fail to make contact with ShivShakti Computers for 30 consecutive days regarding the disposition of your laptop/desktop/printer or any other device, ShivShakti Computers will consider your inaction as abandonment of property. You agree that we may take ownership and/or dispose of such abandoned property and hereby release ShivShakti Computers and waive any claims regarding such disposal.

(e) Repair Turnaround Times: The turnaround times published on the ShivShakti Computers web site/offline do not include shipping time in transit and reflect only actual time in shop. Turnaround time also depends on availability of parts. If required parts are not in stock the turnaround time will not start until parts become available.

(f) Your Responsibility Regarding Shipping: (1) Initial laptop computer and/or other device shipment from you to ShivShakti Computers: It is very important that you properly package your laptop computer and/or other device prior to shipment to us. If you are using your own packaging materials you agree to follow the packaging procedures and standards outlined. If you are using a laptop computer and/or other device shipping container provided by ShivShakti Computers you agree to follow the packaging instructions provided with the box. You further agree that damages that occur during shipping will be sole responsibility of the shipping carrier and that ShivShakti Computers is not responsible for such damages. (2) Final shipment from ShivShakti Computers to you: Upon receipt of returned items from ShivShakti Computers you are responsible for inspecting and noting obvious damages to the package exterior to the Courier delivery person at the time you accept the package. You must accept the package before you can make a damage claim with Courier Delivery. Where shipped items have received damages internally, you are responsible for reporting this damage to ShivShakti Computers with 24 hours after receiving the package at which time we will advise you on Courier Company damage claim procedures. IMPORTANT: You must keep all packaging materials and have them ready for pickup and inspection by a Courier representative. DO NOT RETURN DAMAGED MERCHANDISE to ShivShakti Computers, Courier Company must first validate the damage claim.

(g) Cancelled Orders and Refund Policy: (1) Initial laptop computer and/or other device service requests: If you wish to cancel a laptop computer and/or other device repair service request minimum diagnostic service charges will not return. Even specially demanding or required product order cannot be cancelled.  

You agree that no refunds will be issued for shipping, containers, or express processing fees at any time once an order has been processed and shipped. (2) Return of service parts: All parts purchased and used to facilitate service that you authorize are non-refundable. If the parts are defective in any way and a warranty is included with these parts ShivShakti Computers will instead replace or repair the part as specified in the company and manufacturer warranty agreement for that part. (3) Return of general merchandise: If you wish to return merchandise purchased from ShivShakti Computers that was not used to facilitate service on your computer, such as external accessories, etc, you agree to pay a 20% restocking fee. You further agree that any shipping and handling charges you paid for this merchandise are non-refundable and that return shipping charges are solely your responsibility.

SERVICE LIMITATIONS; LIABILITY

(a) LIMITATIONS TO SERVICE: ShivShakti Computers RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SERVICES AND INSTEAD REFUNDS YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY ShivShakti Computers.

(b) FORCE MAJEURE: If ShivShakti Computers ability to render laptop computer and/or other device repair services is impaired by you or circumstances beyond the control of ShivShakti Computers, ShivShakti Computers may choose not to provide or to discontinue services.

(c) LIMITATION OF LIABILITY: To the extent permitted by law, you agree that ShivShakti Computers total liability for damages related to its services is limited to the total amount you pay for these services (plus parts if applicable), and you release ShivShakti Computers liability for any indirect, incidental, special, or consequential damages. ShivShakti Computers IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

(d) LIMITATION OF LIABILITY DURING SHIPPING: ShivShakti Computers uses Courier Company as a reliable shipping carrier and in most cases. ShivShakti Computers is not responsible for damages that occur during shipping; however damages should be processed using the procedures set forth by Courier Company.

SERVICE WARRANTY

Service warranty policies are outlined on our web site at Warranty & Returns Upon completion of service every laptop/desktop/printer or any device will undergo a thorough quality assurance check prior to shipping to ensure minimal defects. In the unlikely event you should encounter problems associated with the service that was performed on your laptop computer and/or other device you agree to contact ShivShakti Computers within 2 days. A customer service representative will identify to correct the problem via telephone or email, however if this is unsuccessful the representative may authorize the return of the lap laptop computer and/or other device top for a free follow up diagnostic service. You agree to pay all upfront shipping charges associated with returning the laptop computer and/or other device to ShivShakti Computers, however if the problem is reported within 2 days from the date you initially received your laptop computer and/or other device back, and the problem is found to be covered under our warranty policy, you may request to have these shipping charges credited to your account with a maximum credit of Rs.-200. You agree that shipping charges for any warranty service provided past 2 days from the date you received your laptop computer and/or other device will be solely your responsibility.
